Creator Terms

1. About the collaboration

These terms apply between you as a creator and X Beauty AB, reg. no. 559337-9059 (“XNails”, “we”), registered at Fredsgatan 10, 852 36 Sundsvall, Sverige. They govern your application to and participation in XNails Creators. The collaboration begins only once we have approved your application. We start with the PR shipments collaboration type; more types may be enabled over time.

2. Who can become a creator

To become an XNails creator you must be at least 18 years old and legally able to enter into agreements. By accepting these terms you confirm that you are 18 or older. XNails Creators is not aimed at people under 18, and we deliberately do not accept applications from minors. If we discover that a creator is under 18, we will end the collaboration and delete the account. The information you provide must be accurate and up to date.

3. Application and approval

You apply via the portal and are approved manually by XNails. We may pause or end a collaboration at any time, for example if these terms are breached. Approval is not a guarantee of shipments, compensation or any particular scope.

4. PR shipments

Approved creators can request PR shipments. The products we send are a gift for creating content – no sale or consideration is required, but we appreciate it when you share your content. Shipments are subject to availability and approval. The products become yours; you are responsible for any tax on the benefit (see section 8).

5. Live feed and content

In the portal’s live feed you can share ideas and content with other creators. Posts are moderated automatically (see our privacy policy on automated processing). Content that disparages XNails, its products or its staff may be hidden from others. You are responsible for what you publish and may not post unlawful, offensive or misleading material, or content you do not have the rights to.

6. Discount codes

We may give you a personal discount code to share with your audience. The code may only be used honestly and must not be spread via coupon or discount sites without our permission. We may deactivate codes that are misused.

7. Content and rights

You keep the rights to your content. You grant XNails a non-exclusive, royalty-free right to re-share (repost) and use content you tag us in or create within the collaboration, in our own channels and crediting you as the author. If you want us to stop using a particular post, let us know and we will remove it going forward.

8. Compensation and tax

Any compensation is set out in your specific collaboration. You are responsible for reporting and paying tax on benefits and compensation under the applicable rules of the country where you are liable for tax.

9. Advertising rules

You must comply with applicable advertising law and clearly label collaborations as advertising (e.g. “ad” or “paid partnership”), in line with the guidelines of the consumer or supervisory authority in your country.

10. Liability

The portal and PR shipments are provided as is. We are not liable for indirect damages or lost profit arising from the collaboration, to the extent permitted by mandatory law. Nothing in these terms limits liability that may not be limited by law (e.g. for intent or gross negligence).

11. Termination

Both you and XNails may end the collaboration at any time. On termination your personal discount code is deactivated and your access to the portal ends. Compensation already earned is paid out under section 8. Provisions that by their nature should survive termination (e.g. the content licence for already published material and the limitation of liability) continue to apply. How we handle your data after termination is described in the privacy policy.

12. Governing law and disputes

These terms are governed by Swedish law. Disputes are settled by the ordinary Swedish courts. If you are a consumer, you always keep the protection of the mandatory rules of your country of residence, and may bring proceedings there.
